DPR Tidak Konsisten Soal Seleksi Anggota Hakim MK
Jakarta, Jia Xiang – Ada tindakan salah kaprah dan tidak konsisten dari anggota DPR RI terkait keikutsertaan sejumlah anggota DPR dalam seleksi calon anggota hakim Mahkamah Konstitusi yang masih lowong.


Hal itu disampaikan Ketua SETARA Institute, Hendardi melalui siaran pers yang diterima Jia Xiang Hometown pada Rabu (19/2/14) malam.


Menurut Hendardi, antusiasme para politisi itu mengikuti seleksi calon hakim MK merupakan tindakan yang tidak patut diteladani. Mereka makin menegaskan bahwa anggota DPR tidak memiliki konstruksi pengetahuan hukum yang kuat terkait politik pembutan produk hukum, termasuk kepatuhan moral dan etika pada sikap politik mereka sebelumnya.


Karena itu SETARA Institute dan Constitutional Democracy Forum (CDF) menolak partisipasi politisi, terutama yang berasal dari partai koalisi untuk ikutt seleksi menjadi calon hakim MK untuk mengisi dua posisi yang lowong.


SETARA Institute dan Constitutional Democracy Forum (CDF) mendorong DPR melibatkan para ahli dalam proses rekrutmen sehingga akan menghasilkan hakim yang berkualitas. Pelibatan para ahli yang dilakukan oleh DPR dapat mengurangi kecurigaan dan keraguan publik atas produk pilihan DPR dalam memilih dua hakim Konstitusi baru yang berasal dari unsur DPR.


Sebelumnya Putusan Mahkamah Konstitusi RI No. 1-2/PUU-XII untuk Pengujian UU No. 4 Tahun 2014 tentang Perppu No. 1 Tahun 2013 tentang Perubahan Kedua Atas UU No. 24 Tahun 2003 tentang Mahkamah Konstitusi Menjadi Undang-Undang telah menegaskan bahwa Komisi Yudisial tidak berwenang mengawasi hakim MK dan mengembalikan kewenangan masing-masing lembaga negara seperti Presiden, Mahkamah Agung dan DPR untuk menyeleksi calon hakim MK tanpa melalui panel ahli. Selain itu para politisi juga diperbolehkan untuk mengikuti seleksi hakim konstitusi tanpa harus menunggu non aktif dari partai politik selama tujuh tahun.


Belakangan putusan Mahkamah Konstitusi itu memancing minat sejumlah anggota DPR RI dan politisi laionnya untuk mengikuti seleksi calon hakim MK tersebut.
Komposisi hakim MK seharusnya berjumlah 9 orang. Namun pasca penangkapan Akil Muchtar dan pensiunnya hakim MK Harjono, maka jumlahnya tinggal 7 orang.[PR/W1]
