II. METHODS
This study uses socio-juridical approach (socio-legal) that is a combination of normative legal research and / or legal research and social research. The use of this approach is intended to understand the relationship and linkages between the legal aspects with reality in society. (Soemitro, 1998: 34). The method used in this study is a qualitative method or also called naturalistic study. Implementation of this research occurs naturally, it is, in a normal situation that is not manipulated the state and their condition, emphasis on descriptive in nature. Retrieval of data or netting made of the situation appropriately phenomenon is called data capture natural (natural). Therefore, this study requires direct involvement of researchers in the field (Lincoln and Cuba, 1985 in Triyanto, 2011: 229).
