Dalam Pasal 1 Kitab Undang-Undang Hukum pidana diatur mengenai batas-batas berlakunya hukum pidana menurut waktu atau saat terjadinya perbuatan, sedangkan dalam Pasal 2 sampai dengan Pasal 9 Kitab Undang-Undang Hukum Pidana diatur mengenai batas-batas berlakunya perundang-undangan hukum pidana menurut tempat terjadinya perbuatan.
Berkenaan dengan peraturan di atas, Moeljatno mengemukakan bahwa dari sudut Negara ada dua kemungkinan pendirian, yaitu:“Pertama, perundang-undangan hukum pidana berlaku bagi semua perbuatan pidana terjadi di dalam wilayah suatu Negara, baik dilakukan oleh warga negaranya sendiri maupun oleh orang asing (asas territorial). Kedua, perundang-undangan hukum pidana berlaku bagi semua perbuatan pidana yang dilakukan oleh warga Negara, di mana saja, juga di luar wilayah Negara (asas personal). Juga dinamakan prinsip nasional yang aktif.”

Results (English) 2:
