Pemilih Disabilitas Tak Perlu Khawatir

Pemilih disabilitas atau berkebutuhan khusus dan penyandang cacat tidak perlu khawatir terkait hak-haknya sebagai pemilih pada Pemilu 2014. Komisi Pemilihan Umum (KPU) menjamin hak para pemilih disabilitas tak akan diabaikan.

Para pemilih disabilitas tetap memiliki hak yang sama dengan warga negara lainnya dalam penyelenggaraan Pemilu. Meski demikian, KPU selalu penyelenggara Pemilu mengatur ketentuan teknis guna kelancaran penggunaan hak pilih para pemilih disabilitas. Selain mengatur tentang tata cara pendampingan saat pencoblosan, KPU juga mengusahakan kemudahan-kemudahan lainnya, termasuk menyediakan lembar surat suara khusus untuk pemilih tuna netra.

Komisioner KPU, Fery Kurnia Rizkiyansyah saat ditemui Jia Xiang Hometown di Kantor KPU di Jakarta, Senin (13/1/14) menegaskan bahwa saat mencoblos di bilik suara nanti, para pemilih disabilitas harus mendapat pelayanan maksimal. "Ketentuan-ketentuan teknisnya sudah ada, untuk itu seluruh panitia pemungutan suara di masing-masing TPS bisa memberi pelayanan terbaik agar hak politik para penyandang disabilitas bisa terakomodir dengan baik,” kara Fery Kurnia.

Khusus bagi pemilih tuna netra akan disediakan lembar suara khusus (braille template). Namun lembar suara tersebut hanya tersedia uhntuk pemilihan calon anggota Dewan Perwakilan Daerah (DPD). Sedangkan untuk pemilihan anggota DPR, DPRD provinsi dan kabupaten/kota, tetap menggunakan lembar surat suara yang umum.

Pada saat pencoblosan, pemilih tuna netra juga bisa menunjuk orang yang akan mendampingi dan membantunya di dalam bilik suara. Menurut Fery Kurnia, pihak yang berhak mendampingi para pemilih tuna netra ini, adalah anggota keluarga terdekat ataupun orang yang ditunjuk langsung oleh pemilih tuna netra. Bagi para pemilih disabilitas disiapkan formulir Model C7-KWK yang akan digunakan oleh pendamping yang telah ditunjuk.

“Dalam hal ini, kejujuran menjadi kunci utama, sebab petugas penyelenggara pemilu di TPS tidak boleh mengawasi langsung proses pencoblosan di dalam bilik suara,” kata Fery Kurnia.

Perlindungan Hak
Hukum internasional yang melindungi hak pemilih disabilitas dalam menyalurkan aspirasi politiknya antara lain Deklarasi Universal Hak-Hak Azasi Manusia pada tahun 1948 yang untuk pertama kalinya menetapkan kewajiban memberikan akses bagi pemilih disabilitas dalam pemilu. Sedangkan payung hukum di tingkat nasional, terdapat sejumlah payung hukum yang mengatur tentang hak-hak penyandang cacat yang semuanya bersumber dari Undang-Undang dasar 1945 hasil amandemen yaitu pasal 28H ayat (2), Pasal 28I ayat (2).

Dua hak pokok para disasbilitas yaitu mendapat perlakukan yang sama untuk berperan dalam pembangunan dan menikmati hasil-hasilnya serta hak untuk memperoleh akses seluas mungkin dalam mewujudkan kemandiriannya.

Karena itu, secara teknis penyelenggaraan pemilu harus ramah terhadap penyandang disabilitas untuk memperoleh akses informasi terkait pemilu, akses menuju tempat pemungutan suara, dan akses memperoleh surat suara.

Sementara itu, dalam paparan sejumlah lembaga peneliti di hadapan KPU di Hotel Kempinski Jakarta pertengahan tahun lalu, terungkap bahwa diskriminasi terhadap warga disabilitas dalam hal partisipasi politik mereka bagi negara Indonesia masih menganga.

Data tersebut berdasarkan hasil riset yang dilakukan oleh ASEAN General For Desability yang di dalamnya bernaung sejumlah lembaga peneliti seperti The Internasional Foundation for Electoral System (IFES), Persatuan Penyandang Disabilitas Indonesia (PPDI), dan Pusat Pemilihan Umum Akses Penyandang Cacat (PPUA PENCA).

Mereka memantau pemilukada di sejumlah daerah di Indonesia. Mereka bahkan masih menemukan banyaknya panitia pemilu dan KPU yang mengabaikan hak politik para penyandang disabilitas.

Salah satu anggota peneliti, Muhammad Afifudin mengatakan bahwa hasil temuan itu diharapkan bisa menjadi dasar bagi petugas pemilu agar lebih ramah dalam menghadapi para penyandang disabilitas dalam pemilu.

Sementara, Program Manager PPUA PENCA, Heppy Sebayang mengatakan, sudah ada hukum yang mengatur agar KPU menyediakan braille template di TPS, dan menjamin kemudahan akses ke TPS bagi pengguna kursi roda, serta memberikan bantuan pendampingan bagi pemilih berkebutuhan khusus.[JX/W1/U1/E4]
