Pembahasan hasil penelitian didasar

Pembahasan hasil penelitian didasari oleh data hasil penelitian yang diperoleh melalui angket, wawancara dan keadaan yang terjadi di tempat penelitian. Agar lebih jelas maka pembahasan hasil penelitian dilakukan sesuai dengan urutan pertanyaan penelitian.
1. Bagaimana penilaian/persepsi (budaya hukum) orang tua/wali siswa terhadap hukum pendidikan pada jenjang pendidikan dasar.
Berdasarkan data hasil penelitian yang diperoleh melalui angket dan didukung dengan hasil wawancara diperoleh data sejumlah 30 responden orang tua siswa mengatakan bahwa 80 % dari mereka tidak mengetahui peraturan yang ada disekolah anaknya. Ketidaktahuan orang tua siswa terhadap aturan yang ada di sekolah anaknya akan mengakibatkan hilangnya kesadaran hukum yang bersangkutan dalam upya penegakan hokum di sekolah.
Salah satu upaya ke arah partisipasi masyarakat atau orang tua siswa dalam ketaatan terhadap hukum adalah melalui peningkatan kesadaran hukum masyarakat. Scholten memberikan rumusan sebagai berikut; “Kesadaran hukum itu tidak lain dari pada suatu kesadaran yang ada dalam kehidupan manusia untuk selalu patuh dan taat kepada hukum”. Kesadaran hukum meliputi pengetahuan masyarakat tentang hukum, penghayatan masyarakat terhadap hukum, dan ketaatan masyarakat terhadap hukum. Artinya, pemahaman masyarakat tidak boleh terbatas hanya terhadap kaedah hukumnya saja, tetapi juga berkaitan dengan manusia sebagai subyek (pelaku) hukum yang meliputi, pengetahuannya terhadap peraturan hukum (termasuk) isi peraturannya, penghayatannya terhadap hukum serta ketaatannya terhadap hukum. Dalam kaitannya dengan hal tersebut maka permasalahannya yang perlu mendapat perhatian adalah langkah-langkah apa yang dapat ditempuh untuk meningkatkan kesadaran hukum masyarakat yang pada gilirannya tercipta suatu suasana penegakan hukum yang baik
